What matters when renting

Since July 2023 the commission is paid by whoever ordered it

For rental flats Austria applies the first-instructing-party principle: whoever hires the agent pays the agent. If you are asked for commission as a tenant although the landlord hired the agent, that is usually not lawful.

Fixed term or open ended is the most important line

Fixed-term contracts under the full scope of the Tenancy Act run for at least three years and carry a 25 percent discount on the permitted base rent. After one year you can give notice yourself, subject to the notice period.

Gross is not net

Listings usually quote the gross rent including running costs and VAT, but sometimes only the base rent. Only comparing the same figure across several flats tells you which one is expensive.

Deposit, key money and what is allowed

Three gross monthly rents is the usual deposit, interest-bearing and refundable at the end. Key money is only lawful for items actually taken over or for investments of real value, never for the contract itself.

Frequent questions

Why is Innsbruck so expensive?

Because supply cannot grow. The city sits in a valley bounded by mountains on both sides, and the land for new construction is essentially allocated. Add around 30,000 students, strong inward migration and a tourism region all around. The result is the highest price level in Austria, ahead of Vienna and Salzburg.

What does "Sonnseite" mean in Innsbruck?

The slopes to the north (Hötting, Hungerburg, Arzl) face south and get sun even in winter. The valley floor and the locations at the foot of the southern mountains lie in shadow for hours in winter, because the midday sun only reaches 19 degrees while the southern ridge rises 10 to 19 degrees. That difference outweighs any balcony orientation.

How do I find a flat as a student?

The market is tightest in September and February. Our search treats travel time to the university at Innrain as its own anchor: instead of straight-line distance we show how long it really takes by bus, tram or bike. For rooms and halls of residence we are not the right place, for a flat of your own we are.

What do service charges add?

The asking rents here are gross rents, so service charges are included. Heating and electricity are not, and in the Inn valley they run higher in winter than in the lowlands: cold air collects on the valley floor.

Does the second-home restriction apply to tenants?

The Tyrolean spatial planning act regulates USE as a second home, not the form of ownership. Anyone renting a flat as their primary residence and registering there is not affected. Anyone planning to use it only occasionally should clarify before signing whether the flat is zoned as a second home at all.
