What matters when renting

Since July 2023 the commission is paid by whoever ordered it

For rental flats Austria applies the first-instructing-party principle: whoever hires the agent pays the agent. If you are asked for commission as a tenant although the landlord hired the agent, that is usually not lawful.

Fixed term or open ended is the most important line

Fixed-term contracts under the full scope of the Tenancy Act run for at least three years and carry a 25 percent discount on the permitted base rent. After one year you can give notice yourself, subject to the notice period.

Gross is not net

Listings usually quote the gross rent including running costs and VAT, but sometimes only the base rent. Only comparing the same figure across several flats tells you which one is expensive.

Deposit, key money and what is allowed

Three gross monthly rents is the usual deposit, interest-bearing and refundable at the end. Key money is only lawful for items actually taken over or for investments of real value, never for the contract itself.

Common questions

What does a rental flat cost in Vienna?

Asking rents average around 20 euros per square metre gross, that is including running costs. Old buildings under the guideline rent system and subsidised flats are well below that, new builds and furnished short-term rentals above.

Do I pay the agent commission as a tenant?

Usually not. Since 1 July 2023 rental flats follow the first-instructing-party principle: whoever hires the agent pays, and that is almost always the landlord. A commission may only be charged to you if you hired the agent yourself.

What is the guideline rent?

For old buildings under the full scope of the Tenancy Act each province has a statutory guideline value, adjusted by supplements and deductions such as the location supplement. Our own page explains how this is calculated in Vienna.

How many flats do you have compared with willhaben?

Considerably fewer, and we say so openly. Our listings come directly from providers, not from copied portal pages. In return, each flat carries what the big portals do not show: measured noise, heat, sunlight and real travel time.

Does wohnwahn cost anything?

No. We are a private project run by two people, we take no commission and charge neither searchers nor providers.
